Illegal Re-Arrest of Prisoners After Release: A Call for Legal Reform

A serious issue has been affecting prisoners in Pakistan. Many prisoners, after serving their sentences and being released, are immediately re-arrested outside the jail premises. Often, police or intelligence agencies position prison vans near the exit gates and take released prisoners directly into custody again, without proper legal justification.

The Problem: Unlawful Re-Arrests

Legally, when a person has a pending FIR or conviction, all arrests should be properly consolidated under due process. However, in practice, prisoners who have served six months, one year, or more in jail are often targeted with new arrests immediately after release. These arrests are recorded under new charges, even though the person has already completed their previous sentence.

This practice is a clear violation of legal procedures and is considered illegal and arbitrary.

Our Action

To address this, we visited the DIG Office and submitted an application to the Home Secretary highlighting the illegal re-arrests of released prisoners. The application pointed out that using prison vans outside jail gates to detain former inmates without proper legal process is unlawful.

Our application has been forwarded and reviewed by the authorities. The hope is that a proper decision will be made, ensuring that released prisoners are not immediately subjected to arbitrary detention.

Legal Reforms and Public Interest

We plan to take this issue forward in the public interest. The goal is to file a petition in the High Court seeking clear rules and judgments that prevent illegal re-arrests.

If the court passes these regulations, it will establish:

  • A strict legal framework preventing the police or other authorities from re-arresting prisoners immediately after release.
  • Strong consequences for any law enforcement personnel who violate these rules.
  • Protection for released prisoners’ rights and freedom under the law.

This reform is essential to uphold justice and prevent misuse of state power.

Illegal re-arrests of released prisoners undermine the justice system and violate human rights. By enforcing proper legal procedures and holding authorities accountable, we can ensure that justice is upheld, and former prisoners are not unfairly targeted.
