Often, people ask me about situations where the police have detained someone, sometimes holding them in custody for 24 days or more without presenting them in court. They also report that bail points are manipulated, and if a petition is filed, additional FIRs are registered against the detainee.
According to the Constitution of Pakistan, 1973, and the Pakistan Penal Code, whenever someone is arrested, the police are legally bound to present the individual in court within 24 hours. However, in many cases, the police exploit fear and delay, withholding court presentation for days. During this period, deals are sometimes made, bribes are taken, and justice is denied.
Whenever a client contacts me regarding such illegal detention, my advice is clear:
- File for bail immediately, even if an FIR has been registered later.
- Habeas Corpus petitions can be filed in both cases, whether an arrest has been recorded or not.
From my experience, 99% of these petitions result in favorable outcomes, especially during trial. Early legal action ensures that evidence, witness statements, and other crucial details are preserved, many of which are otherwise lost if the police delay filing FIRs or remand papers.
Example: Sahiwal Incident
A recent case in Sahiwal illustrates this problem. A groom and his party were heading to a wedding when police from seven different stations conducted raids, including personnel from three different cities. They reportedly detained 17 individuals, including the bride and a minor girl. Despite this, the police failed to present them in court.
Additionally, police allegedly looted property from the homes during these raids. This shows a disturbing trend: when police conduct operations, they often exceed their authority, and victims suffer both illegal detention and property loss.
High Court Intervention
The matter was brought before the High Court, presided over by Justice Tariq Saleem Sheikh, a judge known for careful and detailed scrutiny. Justice Sheikh reportedly instructed the DPO Sahiwal to ensure the safe recovery of the detained girls and other individuals. The court emphasized that any illegal detentions must be immediately addressed, and all responsible officers held accountable.
