A Powerful and Interesting Vehicle Recovery Case

A very powerful and interesting vehicle case came to us. The issue was that the car’s engine number and chassis number were tampered and content-welded.

The case was brought to us by Tanveer Bhai, a very kind and sincere client. We did not have a long professional history together. He simply came to us, booked his case without even going into extensive documentation discussions, and left,  placing complete trust and confidence in us that one day, his vehicle would be recovered.

The Legal Challenge

In cases involving content, welded engine or chassis numbers, courts generally hesitate to grant custody (supurdari):

  • Magistrates do not grant custody.
  • Sessions Judges do not grant it in revision.
  • Even High Courts are reluctant in such matters.

Despite this, we decided to work thoroughly on the case.

Our Legal Strategy

We carefully prepared our grounds. The most important argument we established was:

  • Our client was a bonafide purchaser.
  • The vehicle had no criminal record.
  • It was not a stolen vehicle.
  • The vehicle was in our client’s lawful possession.
  • Keeping such a high-value vehicle unused and seized was unjust and unlawful.

When we filed the custody application, the Magistrate clearly stated that he would not grant custody and dismissed the application.

At that point, many people around our client discouraged him. Some even said, “You made a mistake hiring that lawyer. The vehicle will never be released.”

When this reached us, the matter became one of professional honor and commitment. We had already done the groundwork. now it was time to take it further.

Criminal Revision Filed

We filed a Criminal Revision Petition, strengthening our legal grounds and arguments.

Alhamdulillah, our efforts bore fruit.

Today, Tanveer Bhai is sitting in our office with sweets in his hands, because the vehicle has been successfully released on custody.

Resistance from Authorities

However, the matter did not end there.

Even after the court order for custody was passed, the concerned SP refused to release the vehicle, claiming that since it was a welded case, custody could not be granted.

We immediately filed a Contempt Petition.

Once notices were issued and the pressure of court proceedings began, the vehicle was recovered and released, almost overnight.

Final Outcome

Today, Tanveer Bhai and Naveed Bhai are with us, thankful and satisfied.
