Waqas Bhai was facing a false cheque dishonour case. After his bail application was dismissed by the High Court, he was arrested at approximately 10:00 AM from within the High Court premises itself.
This action raises serious legal concerns.
Arrest from Court Premises – A Violation of Legal Principles
The Supreme Court of Pakistan has repeatedly emphasized that an accused person should not be arrested from court premises immediately after dismissal of bail, as such actions undermine the sanctity of the court and the dignity of judicial proceedings.
Despite these established principles, Waqas Bhai was arrested directly from the High Court premises.
28 Hours of Illegal Detention
The situation became even more alarming after the arrest:

He was kept in Shadman Police Station.

Approximately 28 hours passed.

No formal arrest entry was made.

He was not produced before a magistrate.

No physical remand was obtained.

He was allegedly pressured in connection with the complainant to release payment.
Under the law and Constitution of Pakistan, any arrested person must be produced before a magistrate within 24 hours. Detaining someone beyond that period without judicial authorization amounts to illegal detention and is a direct violation of fundamental rights.
Immediate Bailiff Action
When Vikas Bhai managed to reach out and inform us of the unlawful detention, immediate action was taken.
